Failure to Monitor Prescription Drug Use May Constitute Medical Malpractice

A recently filed lawsuit asserts that a prescription error led to the death of a California man.

Various different types of prescription errors may form the basis of a medical malpractice lawsuit. For example, in some situations, the wrong type of medication may be prescribed, or it may be given in the wrong dosage amount. In birth injury cases, the administration of excessive amounts of Pitocin may cause harm both to the mother and the newborn.

In this instance, the surviving widow asserted that the doctors in charge of overseeing and monitoring her husband’s care failed to assess and convey the risks involved in taking multiple medications. She further asserted that the doctors then abruptly stopped providing medications including lorazepam, rather than wean him from the medications.

Shortly thereafter, the decedent became suicidal, eventually taking his own life. The lawsuit asserted that he communicated with defendants that he was experiencing severe withdrawal symptoms but that defedants failed to care for the man "in a manner reasonably designed to provide relief from his symptoms.”

The lawsuit settled for an undisclosed amount.
