The Failure to Respond Rapidly to Fetal Distress May Constitute Medical Malpractice

The family of a child born with a brain injury has just secured a record setting birth injury verdict. According to reports, a just has awarded a 12-year-old boy and his mother $53 million in a medical malpractice lawsuit. The birth injury lawsuit was filed a little over 3 years ago asserting that the doctors and nurses in change of her care did not provide proper treatment during her pregnancy and the child's birth. As a result of the negligent medical care, the boy now requires help feed, bathe and go to the bathroom.

The family alleged that the health care professionals failed to perform a timely Cesarean section after the baby starting showing signs of fetal distress. However, here the health care professionals delayed in taking precautionary measures, the family asserted.

The hospital disagreed, arguing that the child's cerebral palsy was a result of an infection.
