Anesthesia Errors may be Fatal

According to news family of woman who died following a CT scan has been awarded $29.5million following a medical malpractice wrongful death trial. Evidence presented at trial to the jury revealed that the woman was given contract dye when having the scan and she subsequently went into anaphylactic shock and lost consciousness. Representatives of the family argued that the doctor was negligent in failing to properly monitor the 40-year-old after the dye was administered and failing to give her medication once she started to have the allergic reaction, which could have reversed her anaphylactic shock. Although the doctor gave her Benadryl, this was inadequate to prevent the harm caused and her subsequent death the family asserted. The jury apportioned the damages as follows:

$1.5 million for pre-death pain and suffering,

$5.5 million to each of the woman’s 4 children for loss of parental consortium; and

$6 million to the woman’s husband for spousal support.

Anesthesia and medication errors are one of the more common sources of medical malpractice. Unfortunately, when an error occurs, the results may be catastrophic- even deadly.

While not all negative outcomes are the result of medical malpractice, where a doctor, nurse or other medical staff acts negligently and harm occurs, they may be liable for and held responsible in a medical malpractice lawsuit.
