Negligent Prenatal Care Leads To Lawsuit

Legal news reports that a birth injury lawsuit has been filed as the result of negligent prenatal and delivery care.

According to the article, the healthcare providers, including a certified nurse midwife, failed to properly manage the delivery. The medical staff in charge of her care knew that the pregnancy was classified as high risk and that the mother suffered from gestational diabetes. Additionally, the medical malpractice lawsuit asserts that several errors occurred that were the result of substandard medical treatment.

The complaint alleges that the mother was admitted to the medical center in order for labor to be induced. She was administered Pitocin intravenously to expedite labor and induce contractions. While the midwife performed a vaginal examination, she failed to take into consideration the fetal weight of the baby.

During the delivery, the baby experienced shoulder dystocia, which should have made the delivery an obstetric emergency necessitating caution. However, the midwife allegedly used excessive force. When the baby was born, he weighed close to 9 pounds, had facial bruising, no left are movement and limited movement of the right arm. An examination should that he had suffered a brachial plexus injury.

The alleged errors included:

Not properly ascertaining the risk factors for shoulder dystocia;

Using excessive force and traction to deliver the child;

Not ordering and performing a C-Section; and

Failing to provide the medical treatment called for in the situation.
