Management Of Delivery Complications At Issue in Birth Injury Lawsuit

Personal injury law reports that the parents of a stillborn baby have filed a birth injury lawsuit against the doctors and the health care system that provided care to the mother and infant. According to records, the mother visited her doctor on her due date with complaints consistent with Primagravida – a condition referring to first time pregnancies. She was told to schedule a follow-up appointment for 6 days later. However, the following day she experienced serious, sustained abdominal pain and was sent to the emergency room. Once there, she informed the physicians and staff in attendance that she one day past due and had started experiencing contractions 10 minutes apart.

The mother was again sent home despite the fetal monitoring strips indicating questionable decelerations requiring continuous monitoring. The mother's symptoms continue to worsen, and when she arrived at the medical center she learned that her child had died.

Medical records show a suspected placental abruption. The lawsuit alleges that the obstetrician and medical center were medically negligent by failing to provide the mother the appropriate standard of care, and that this failure led to the demise of the child.

The wrongful death lawsuit is seeking both physical and emotional damages for both parents due to the loss of the child.

Birth complications that lead to tragic outcomes, whether a serious birth injury that affects a child for a lifetime, or as here – a wrongful death – are often preventable. In these instances, it may be possible to file a medical malpractice lawsuit. While talking to a lawyer may be the furthest thing from your mind at this difficult time, an experienced birth injury attorney may be able to help provide your family resources, and explore your options.
