Jury Verdict Awarded In Surgical Error Case

A jury has just awarded a husband a $3 million verdict in a medical malpractice lawsuit filed after the death of his wife. The woman died just two days after surgery at a nearby hospital.

According to reports, the woman went into surgery for the removal of an ovarian cyst. During the procedure her bowl was pierced, a known complication of the surgery. However, despite the woman's complaints following the procedure, the surgeon failed to adequately inspect her bowel for cuts.

Evidence presented at trial suggested that the doctor failed to respond quickly enough to signs that a problem existed, including that the woman started belching following surgery, requiring her to be treated in the emergency room.

Medical malpractice may be found where a doctor, nurse or other health care provider fails to meet the requisite standard of care for a particular practice or area of medicine, and as a result of this failure, a patient is harmed.
