Medical Malpractice Lawsuit Filed Following Birth Injury

A multi-million dollar birth injury lawsuit has been filed as the result of numerous complications that occurred during the labor and delivery of a Texas boy. According to reports, the child suffered a severe brain injury and now suffers from neurological, cognitive and developmental delays. The medical malpractice lawsuit alleges that numerous breaches of the necessary standard of care occurred, harming the newborn.

The medical malpractice complaint alleges that the mother was induced at 36 weeks pregnant, after she came to the hospital suffering pelvic pressure and secretions. During the delivery process, the child's shoulder became lodged in the mother's birth canal – indicating possible should dystocia. The baby showed signs of distress, and physicians used vacuum extraction to assist with the delivery.

The child suffered perinatal asphyxia, and was blue when he was delivered. The child failed to respond to stimuli and was transferred to the Intensive Care Unit for observation and care. When the child was born, he was blue, flaccid and failed to respond to any stimuli.

The negligence lawsuit seeks damages to compensate the family and child for the harm caused by the hospital and doctors, and to help cover the costs of a lifetime care.

The impact of birth injuries can last a lifetime. For more information or if you that your child may have been harmed by medical malpractice, please contact the dedicated Los Angeles birth injury attorneys at Bostwick & Peterson, LLP for an immediate consultation.
